Statement of President of the Republic of Indonesia on Follow-up on the Constitutional Court’s Ruling against Job Creation Law, 29 November 2021, Jakarta

Assalamu’alaikum warahmatullahi wabarakatuh,

Good afternoon,

May peace be upon us all,

 

Ladies and Gentlemen,

The Government’s commitment and my commitment to the agenda of structural reform, deregulation, and debureaucratization will continue to be made. I will continue to lead and assure legal certainty and government support for ease of investment and ease of doing business.

As a democratic country based on the rule of law, the Government respects and will immediately implement the Constitutional Court’s (MK) ruling Number 91/PUU-XVIII/2020.

I have ordered the related Coordinating Ministers and Ministers to immediately follow up on this ruling. The Constitutional Court has ruled that the Job Creation Law is still in effect.

The Government and the House of Representatives, as the lawmakers, are ordered to revise and amend the Law within two years. Therefore, all prevailing implementing regulations for the Job Creation Law are still in effect.

With the Job Creation Law declared still in effect by the Constitutional Court, all subjects and substances in the Job Creation Law and its regulation remain in effect without any article being annulled or declared invalid by the Constitutional Court.

For that reason, I ensure both domestic and foreign businesspersons and investors that investments that have been made, as well as investments that are and will be in progress remain safe and secure.

Once again, I ensure that the Government guarantees investment certainty and security in Indonesia.
